Terms of Service

Welcome to Bombooru. This agreement (the “Terms”) sets out the conditions under which you may visit or use this website and any related services (together, the “Service”). Using the Service means you accept these Terms. If you do not accept them, do not use the Service.

Your use of the Service is also subject to our site rules and our Privacy Policy. Those documents are part of the overall rules of the Service.

1. Eligibility and Accounts

You must be at least 18 years old (or the higher age of majority where you live) to register or use the Service. By registering or continuing to use the Service, you confirm that you meet that age requirement under the laws that apply to you.

We may restrict, suspend, or permanently close your account, or block access to the Service, at any time and for any reason we consider appropriate. That includes, without limitation, breaches of these Terms or of the site rules.

2. Prohibited Conduct

You agree not to do any of the following while using the Service:

  • Open extra accounts to dodge bans, restrictions, cooldowns, or spam filters.
  • Work around limits we place on accounts (uploads, comments, API rates, post visibility, and similar controls).
  • Hand over, sell, rent, or otherwise let someone else operate your account.
  • Buy, sell, or trade upgraded or staff-level accounts (including paid membership tiers or elevated roles, if offered).
  • Send bulk unsolicited messages through comments, forums, or private mail.
  • Try to break into another person’s account, our systems, or related infrastructure.
  • Upload, host, or link malware, exploits, or other hostile software.
  • Interfere with other users’ ability to use the Service, or degrade performance of the Service.
  • Run bots or automation that harm the Service or that are designed to dodge limits we set.

3. User Content

Everything people post on the Service—text, links, notes, tags, images, video, audio, and other material (“Content”)—is the responsibility of the person who submitted it. We do not claim ownership of your Content, and we are not responsible for Content uploaded by users.

Content must follow these Terms and the site rules. We are not required to review every submission, but we may remove or hide Content at our discretion when we believe it violates the rules, creates legal risk, or is otherwise inappropriate for the Service.

The Service may expose you to Content that is adult-oriented, offensive, inaccurate, mistagged, or illegal where you live. You use the Service and any Content at your own risk. We do not guarantee that Content is complete, true, accurate, or reliable, and we do not endorse user opinions.

By uploading Content, you state that you have the rights needed to post it and to grant the license below. You are solely responsible for your uploads and for complying with applicable law. Posting Content you do not have rights to may create legal liability for you.

When you submit Content, you grant Bombooru a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable license to host, store, copy, adapt, display, distribute, create derivative works from, and allow downloads of that Content in any media or channel, now known or later developed, for the purpose of operating, promoting, and improving the Service.

4. Copyright Complaints (DMCA-Style Notices)

If you believe Content on the Service infringes your copyright, you may send a written notice to dmca@bombooru.org (or another address we publish for this purpose).

A complete notice should include:

  • Your contact details (legal name, mailing address, phone number, and email).
  • Enough detail to find the material (for example, direct links to each post). Artist names or screenshots alone are usually not enough.
  • Identification of the copyrighted work you claim is infringed (for example, a link to the original on your site or social profiles).
  • A good-faith statement that the disputed use is not authorized by the owner, their agent, or the law.
  • A statement that the notice is accurate and that, under penalty of perjury, you are the owner or are authorized to act for the owner.
  • Your physical or electronic signature (full legal name of the owner or authorized agent).

Incomplete or false notices may be ignored. Fair use and similar doctrines may permit some uses without permission. Knowingly filing a bad-faith claim can create liability for you.

Facts and data that are not protected by copyright (such as many tags, basic wiki facts, or plain links to public profiles) are generally not removed solely because of a copyright complaint.

5. Paid Features (If Offered)

If we offer paid upgrades or other paid products, you may provide payment details through our payment processors. By purchasing, you agree to pay amounts due, including applicable taxes and fees, and authorize us (or our processors) to charge your payment method when payment is owed. Pricing and benefits may change with notice when practical; short-term promotions may not require advance notice.

6. API Access

If you use our API, you must respect documented rate limits and any other technical or usage restrictions we publish. Abusive API use may lead to key revocation or account action.

7. Privacy

How we handle information about you is described in the Privacy Policy. Using the Service means you understand that handling of information as described there.

8. Definitions and Boilerplate

“Bombooru,” “we,” and “us” mean the operators of this Service, including successors and assigns. “You” means anyone bound by these Terms.

These Terms are the full agreement between you and us about the Service. If we do not enforce a provision, that is not a waiver. If a provision is invalid, the rest remains in force. You may not assign your rights without our consent; we may assign these Terms.

9. Changes

We may revise these Terms. Updates will show a new effective date at the top. For significant changes we may post a notice on the Service. Revised Terms apply once published. Continued use after that means you accept the updated Terms.

10. No Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE, OR THAT SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT CONTROL OR ENDORSE USER CONTENT OR THE ACTIONS OF USERS OR MODERATORS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT ALLOWED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, INCLUDING LIABILITY RELATED TO USER CONTENT. YOU USE THE SERVICE AT YOUR OWN RISK. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE SIX MONTHS BEFORE THE CLAIM. THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
